Effective January 19, 2021, The Federal Housing Administration (“FHA”) is allowing individuals classified under the Deferred Action for Childhood Arrivals (“DACA”) program who are legally permitted to work within the United States to apply for FHA insured mortgages. Previously, the Single-Family Housing Handbook provided that “Non-US citizens without lawful residency in the U.S. are not eligible for FHA-insured mortgages.” According to the FHA News release, Handbook 4000.1 Section II.A.1.b.ii(A)(9)(c) will be waived until the handbook can be updated to remove the quoted language.
