June 23, 2021, the Supreme Court of the United States (SCOTUS) issued its decision in Collins v Yellen, ruling that the director of the Federal Housing Finance Agency (“FHFA”) can be removed by the President at will. Like the decision SCOTUS issued last June in Seila Law v. CFPB, the court’s decision effectively severs the ‘for cause’ removal provision from the Housing and Economic Recovery Act of 2008.
